What is RERA Registration?
RERA stands for the Real Estate (Regulation and Development) Act, 2016. This law was made to protect home buyers and to bring clear rules for builders, developers and property agents. Every state and Union Territory has its own RERA Authority, and it handles the registration of real estate projects and agents in that state.
There are two kinds of RERA registration:
| Type |
Who Must Register |
|
Project Registration
|
Builders, developers and promoters of residential and commercial projects
|
|
Agent Registration
|
Real estate agents and brokers who help in the sale or purchase of plots, flats or buildings in registered projects
|
After registration, the project or agent receives a RERA registration number. This number must be shown in all advertisements, brochures, websites and sale documents.
CA Arpit Gupta helps builders, promoters and agents with RERA registration, CA certificates, quarterly updates and yearly compliance.
Which Projects Need RERA Registration?
A real estate project must be registered with the state RERA Authority before it is advertised, marketed, booked or sold, if it meets any of these conditions:
- The land area is more than 500 square metres, or
- The project has more than 8 apartments, including all phases
Some states have set their own limits within the Act. A project that already got its completion or occupancy certificate before the Act came into force is not required to register. Please check the rules of your state before you decide.
Who Needs to Register as a RERA Agent?
You need to register if you work as a:
- Property broker or dealer
- Real estate agent
- Marketing or sales agent for a builder
- Company or firm that helps buyers and sellers in plot, apartment or building deals
An agent who deals in projects that are registered under RERA must also hold a RERA registration. Selling or advertising a property without it is an offence.
What Are the Benefits of RERA Registration?
For builders and promoters:
- Legal permission to advertise, book and sell the units
- Trust of home buyers and banks
- Easier bank loans, since lenders prefer registered projects
- Clear framework for payments and timelines
- Better brand image in the market
For agents:
- Legal right to deal in registered projects
- Trust of buyers and builders
- Protection from penalties
For home buyers:
- Safety of their money, with a part kept in a separate account
- Clear information about the project, plans and completion date
- Right to complain to the authority in case of delay or fraud
What Is the Role of a Chartered Accountant in RERA?
A Chartered Accountant is needed at several steps:
- Certificate for fund use when the promoter withdraws money from the project account
- Annual audit of the project accounts
- Statement of accounts and details of the cost of the project
- Estimated cost and funds for the registration application
- Tax and GST compliance linked to the project
CA Arpit Gupta can help with all these CA-related works along with the registration.
